代写论文【摘要】 商品房“假按揭”是在“按揭”的基础上衍生的新兴问题。而在当今中国,由于各项法律法规及其对应的相关制度对按揭的规定都还仅仅限于相对初级阶段。因此,在“假按揭”出现后相关责任人如何归责,以及利害关系人如何防范假按揭问题就显得尤其重要。所以,深入研究假按揭的原理、假按揭所形成的原因、假按揭所造成的风险,最终完善相应的防范措施是十分必要的。本文除去绪论和结语外,共分为四个部分。本文的第一部分是从“按揭”与“假按揭”的相关原理入手,介绍了按揭的由来和在我国的发展、按揭的定义、按揭的法律属性等相关原理问题。同时,着重对“假按揭”的涵义特征和表现方式进行讨论研究。目的是为了介绍本文的基础原理,为后文的论述作引导和铺垫。本文的第二部分,首先讨论“假按揭”的产生原因,主要是从市场的角度和制度方面分析。其次,在这一部分研究了“假按揭”所带来的风险。这一部分采用了按照一分为二法,对假按揭所带来的风险进行了剖析。研究这一部分内容的主要目的是为了理清假按揭的危害和产生的原因,为后文的制度完善做相应的准备要件。本文的第三部分分析了我国目前对“假按揭”的责任划分,归纳出我国现有的关于防范“假按揭”法律法规、及一些法律保护制度。同时,总结出我国现阶段制度的不足点,以期为后文完善铺陈。本文的第四部分,依据上文所论述的相关原理以及制度方面的不足,结合了理论和我国现阶段的国情,从完善银行监管和完备法律法规两方面提出了防范“假按揭”风险制度的相关建议。本文的研究成果之一是:明确了我国商品房按揭的属性和法律关系,明确按揭是一种特殊的不动产抵押。对“假按揭”特征经过理论和实践总结并做出较为全面的分析。对“假按揭”的表现方式从银行审查时的形式要件角度和房地产开发商角度进行分析得出结论。本文的研究成果之二:针对“假按揭”问题,从紧密结合实务中商品房操作流程入手,深入分析了“假按揭”的形成原因及风险,针对我国防范“假按揭”风险的法律规定及问题,提出具有较强操作性的预防措施,完善防范商品房“假按揭”的相关制度规定。

The purpose is to introduce the basic principle, this paper after wen made for guidance and matting.Part ii of this article, the paper discusses the "Fake mortgage" reasons, mainly from the Angle of the market and system analysis. Secondly, in this part of the study the fake mortgage "brings the risk. According to this part of adopted two method, the fake mortgage brings the risk and analyzed. Study this part of main purpose was to clear the dangers of fake mortgage, and the causes of the complete system for later under the corresponding prepare requirement.This paper analyzed the third part of our current "fake mortgage" responsibility divided, concludes our country’s existing about preventing "Fake mortgage" laws and regulations, and some legal protection system. Meanwhile, summed up the present system, in order to insufficient points after wen perfect elaborate language. The fourth part, according to the relevant principles discussed above, as well as institutional deficiency of combining theory and our country’s situation, banking supervision from the perfect and complete legal regulations against the two aspects of "Fake mortgage" risk system related Suggestions.The result of this paper is the one house in China:define the attribute and legal relationship mortgage, clearly mortgage is a special kind of real estate mortgage. "Fake mortgage" characteristics of through theory and practice summarizes and make more comprehensive analysis. For "Fake mortgage" means of expression when reviewing form from the bank Angle and real estate developers Angle element analysis concluded.The result of this paper aimed at no.2:"Fake mortgage" problems, from closely combining the practice of commercial operation flow, deeply analyzes the formation of "Fake mortgage" reason and risk prevention, aiming at China "Fakemortgage" risk law and problems, this paper puts forward with strong prevention measures, improve operational prevent commodity house "Fake mortgage" related regulations.
