【摘要】 自我国住房体制改革以来,住房市场化的推行,活跃了商品市场,减少了政府的财政负担,但同时由于市场的盲目性、自发性、滞后性,我国的商品房市场出现了一系列的问题,特别是随着房价的步步高升,人们的购房压力愈来愈大,为保障人们的基本住房问题,我国先后提出了经济适用房制度、廉租房等社会保障性住房体制改革,但由于产权问题、监管问题、体制问题、法律制度的不完善导致我国经济适用房保障制度种种问题的出现,因此急需完善的住房保障体制及法律的出台,为解决我国中低收入家庭基本住房保障,各地区纷纷加大探索、改革创新、加强立法。淮安市在经济适用房共有产权制度的积极探索,创新性的提出经济适用房政府与个人按比例共享所有权的新型模式。经济适用房共有产权制度较为清晰的确定了政府和个人之间的产权比例,但是政府本身作为一种公权力的拥有者而参与民事共有,就会存在产权在使用上的问题,同时另一方面政府如何发挥职能作用,更好的对经济适用房共有产权进行监管,这是经济适用房共有产权在实践中所面临的问题。本文就是从产权和监管两个角度对经济适用房共有产权进行分析,并提出完善的建议。本文分为五个部分:第一部分,经济适用房共有产权制度的理论概述。分析经济适用房共有产权制度下的产权特征及其经济适用房共有产权制度的社会保障性特征。第二部分,我国实行经济适用房共有产权制度的正当性分析,即法理性分析。本部分主要是从两个方面进行阐述,一方面通过公民的居住权是公民的基本权利,国家有义务保障公民居住权;另一方面是政府干预市场的理论,在市场失灵的情况下,造成不能够进行公平合理的分配时,通过国家经济法干预的手段,满足社会弱势群体的住房保障。第三部分,国外住房保障制度的实践经验及其借鉴意义。通过对英国(共有住房产权制度)、美国(发达的房地产金融)、新加坡(中央供给金制度)等发达国家在住房保障制度成功的实践经验,揭示出对我国在进行住房保障制度改革中的借鉴经验。第四部分,我国经济适用房共有产权制度存在的问题和原因。此部分是从两个方面对存在的问题进行阐述。一是产权问题,即经济适用房共有产权制度下的政府产权如何使用;二是监管问题,经济适用房共有产权制度由于监管的缺失,导致经济适用房出现很多的问题,例如立法体系的不完善、房屋建设标准的失控、准入和退出机制监管的缺失等。第五部分,完善经济适用房共有产权制度的建议。针对我国经济适用房共有产权制度出现的问题,从产权和监管(六个方面),提出完善经济适用房共有产权制度的建议。

【Abstract】 With the reforms of our country housing system and the housing marketization, it has led to not only the development of commercial housing market active, but also a reduction of government’s financial burden. Nevertheless, a series of problem emerged in the development of the housing market owing to the backwardness, spontaneity and blindness of the market. Especially as the housing price escalating, purchasing house makes residents shoulder a huge pressure. To protect people’s basic housing, China has proposed the system of affordable housing, low-cost housing, and other social security reform. But because of the housing guarantee system problems which dues to the imperfection of the property and regulatory issues of legal system in China. The Perfect housing guarantee system and law is necessary. To give the basic housing security of low-income families, the governments have put forward many innovations and improved legislation. There is a new model that government and individual share ownership in Huaian. It is more clearly to define property between the government and individuals, but there are many problems in the civil relation which the government and individuals take part in. For example the using of property and how the government play a role to supervise the system of economically affordable housing. The article analysis the system of economically affordable housing from the property and supervisory system.This article is divided into five parts.PartⅠ, the theory of system of economically affordable housing common property. The part analysis system of economically affordable housing common property from the characteristics and social security.PartⅡ, the legitimacy of system of economically affordable housing common property in China. This section is mainly explained from two aspects. First, the right of residence is the basic right of citizens, protecting the citizens right of residence is obligation of the government. Second, the theory of government intervention, in the case of market failure, we can not distribute equally through the market. We need to protect the vulnerable groups.PartⅢ, foreign housing safeguard system and the practical experience for reference. Through the United Kingdom (Total housing property system), the U.S. (advanced real estate finance), Singapore (the central supply fund system) and other developed countries in the housing security system, we could get many successful experiences to improve our system.PartⅣ, the problems and causes of system of economically affordable housing common property. What causes the problem? First, because of the property rights. The system of property right is uncleaf. Second, because of the regulatory issues: There are a lot of problems on system of economically affordable housing common property, as the imperfect legislative system, the uncontrolled housing construction standards, the lack of supervision on enter and exit mechanism.PartⅤ, the advice to improve the system of economically affordable housing common property. To improve the system of economically affordable housing common property,the article gives some advices from property and regulation (six parts).
