【摘要】 本文运用历史制度主义的分析方法研究了20世纪70年代美国建立公职人员财产申报制度建立的影响因素,以试图寻找该制度得以建立的原因,对我国建立公职人员财产申报制度提供借鉴。在研究美国公职人员财产申报制度的文章中,大多关注于该制度具体内容,很忽视其制定的过程,忽视其获得通过的原因。而法律能否获得通过决定了该制度效力的发挥,因此对法律、政策获得通过原因的研究是很有意义的。本文根据历史制度主义分析方法,在美国宏观政治制度下研究中观和微观层次的变量,即分析了美国政治决策机构和个体政治行动者的影响。通过对其影响因素的分析发现公职人员财产申报制度的建立得益于立法机关权力的强大、政治领导人个人的反腐败决心以及民间社会力量的推动。为此,我国可以从强化人民代表大会的立法作用和发挥民众力量等方面进行推动公职人员财产申报制度的建立。
代笔硕士论文【Abstract】 In this paper, Historical Institutionalism is used to research the factors of the establishment of Family Properties Declaration System in the 70s of 20th century. So we can learn from its experience when we set the Public Officials and Property Declaration System. Most articles of Family Properties Declaration System focus on content of the system while ignoring its process and ignoring the reasons of its adoption. The effectiveness of the system will play only when it is a law, so it is necessary to study its process. According the Historical Institutionalism, this article choose the meso-level and micro-level variables which are the U.S. political decision-making bodies and individual political actors under the macro-political system in the United States. From the research, we find that the establishment of the Family Properties Declaration System is benefited from power of the legislature and the political leaders’determine to anti-corruption and civil society’s forces. We can promote the establishment of Public Officials and Property Declaration System from reinforce power of the legislature and strengthen the civilians’role.
