【摘要】 食品安全涉及到广大人民群众的身体健康和生命安全,随着近年来全球贸易一体化的发展。世界各国尤其是发达国家都对进口食品安全问题十分重视。我国由于对进口食品安全监管起步较晚,监管法律法规及监管体制相对不完善。加强和完善我国进口食品安全监管的构建显得更为重要和迫切。本文主要通过学习和借鉴国外发达国家对食品安全监管法律,分四部分对我国进口食品安全监管体系法律方面相应对策的思路问题进行论述：第一章：对进口食品安全领域的相关概念进行简述。主要介绍食品安全相关概念,对进口食品安全的重要性进行阐述。第二章：对国外进口食品安全监管法律进行分析,对美国、欧盟、加拿大和日本现有食品安全监管进行简要分析,归纳总结发达国家食品安全监管体制的主要特征。第三章：我国进口食品安全监管法律现状分析,首先对我国食品安全监管体制的发展历史进行了概述,接着分析了我国进口食品安全监管的现状,最后提出我国进口食品安全的监管法律存在的问题。第四章：完善我国进口食品安全监管法律的对策,主要针对完善现有法规、明确责任、领导问责、维护知情权、实现追溯以及完善人力资源建设六个方面提出相应的对策。

Meantime, food security is the embodiment of the counity and government ability, which relating to the international image to the government, from the central government to the local governments are all pay more and more attention on the safety mangerment of imported food. The implementation of the ’Food Safety Law of People’s Republic of China’, it has more clearly the rights and responsibilities of various departments in the charge of food security; improve the knowledge-sharing and standards docking between various regulatory bodies, and also promoting the research and integration of imported food security theory, providing the theoretical support for the improvement of relevant laws and reform of regulatory system. This law has to provide more reliable safeguardssystem of Chin’s food security, thus to guarantee the food safety, ensure public health and safety. This article from the perspecive of government, through the studying and learning from the foreign advanced experience of food safety regulation, anaylsis of our problems and deficiencies of the regulation in the imported food safety, then to discuss for improve our laws and regulations in the impored food safety monitoring. Then to put forward a series recommendations and measures in China’s impored food safety monitoring. Highlight the leading and coordination role of government in the food safety supervision, accelerate the improvement the laws and regulations of Chinese imported food safety monitoring, improving the communication and coordination between the various regulatory departments in law enforcement for food safety monitoring, and clearing the legal status of institution-building, terms of reference and legal responsibility. First, the government should establish and improve the regulatory enforcement responsibilites, through quantitative and detailed the enforcement responsibility of all aspects in food safety monitoring for law enforcement officals perform the standards of duties according. Development of a unified scientific standards, norms various factors that need attention in the food safety assessment, so that the risk assessment process can to achieve the law, based on the evidence. Speed up the development of information technology, training the awareness of directly involved in food safety monitoring activities for public, while oversight the implementation of food safety monitoring by government. Then to promote the comprehensive nature of Chinese imported food safety monitoring, make the government departments, producers, food consumers are all have been involved in the field of food safety monitoring.In addition to the introduction and conclusion, the paper is divided into four parts: Chapter I, an overview of the legal of imported food security. Mainly includes two aspects: 1, related concepts of imported food safety monitoring, the main defining the definition of imported food and the nature of imported food monitoring; 2, the importance of the imported food monitoring. To defining the features of imported food safety monitoring, included full regulatory supervision and according to the law. At the same time, get analyze the importance of imported food saftey supervision. The imported food safety regulation is the fundamental reflected of government to maintain the interests of masses, the fundmaental performance of government to improve the overall competitiveness, menawhile it could be facilitating the development of global integration of economic.Chapter II, the foreign legal analysis of imported food safety supervision. Mainly fromtwo aspects: First, the situation of imported food security legal regulation: a brief analysis of present food safety supervision in United States, European Union, Canada and Japan; Second, summarizes of foreign food safety regulatory system’s main features, full monitoring, there are potential safety hazards in the all links of food production, processing, distribution, sale and consumption, to fully monitoring and prevent those potential food safety hazards, and avoid the problems of food in the processing, packaging, transport, storage and sales, then be available to support sfaety food to public; sound law and Enforcing Standard, Most developed countries had to establish a legal system for various aspects of food regulation from production to sale, for the development of regulatory policies, testing standard and quality certification to system is now the internationally accepted food safety precautions, U.S., EU and Japan have special attention to analysis scientific rationality in the evaluation process. The mainly of prevention and control, and implementation of retrospective, on all aspects of food production to conduct a comprehensive analysis, can effectively prevent and control food safety hazards that may exist, and implementation of monitoring for specific critical points In the production process.
